Terms of Service
1. Acceptance of Terms
These Terms & Conditions (the "Terms") govern your access to and use of the AAICognitive SRL website, apps, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You may not use the Service if you are prohibited by applicable laws or if your account has been suspended or removed previously.
3. Accounts & Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@oddshaven.ai of any unauthorized use. We may require multi‑factor authentication and may suspend access to protect you and the Service.
4. Subscriptions & Billing
The Service may be offered via paid subscriptions billed in advance on a recurring basis (e.g., monthly or annually) until canceled. Prices, features, and billing intervals may change with prior notice where required by law. You can manage or cancel your plan at your billing portal. Cancellations take effect at the end of the current paid term; we generally do not prorate or offer refunds for partial periods. Taxes may apply and are your responsibility.
5. Content; No Betting Advice
The Service may present data, analytics, and opinions derived from models and third‑party sources. Such content is for information only and does not guarantee outcomes. Past performance does not predict future results. You acknowledge that wagering involves risk and you should only bet what you can afford to lose. Where betting is illegal, you must not use the Service to facilitate wagering.
6. Acceptable Use
Do not: (a) share, resell, or sublicense access; (b) scrape, crawl, or harvest data without written permission; (c) reverse engineer or attempt to extract source code; (d) upload malware or interfere with the Service; (e) use the Service for unlawful purposes; (f) misrepresent your affiliation; or (g) bypass technical controls, rate limits, or access restrictions.
7. Intellectual Property
The Service, including software, features, content, text, graphics, logos, and models, is owned by AAICognitive SRL or its licensors and is protected by intellectual property laws. Subject to your compliance with these Terms and any applicable subscription limits, we grant you a personal, non‑exclusive, non‑transferable, revocable license to access and use the Service.
8. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR‑FREE, OR THAT RESULTS WILL BE ACCURATE OR RELIABLE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AAICognitive SRL AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
10. Indemnity
You agree to defend, indemnify, and hold harmless AAICognitive SRL, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service or violation of these Terms.
11. Termination
We may suspend or terminate your access to the Service at any time for any violation of these Terms, fraud, abuse, or risk to the Service or other users. You may stop using the Service at any time. Sections that by their nature should survive termination will survive (e.g., intellectual property, disclaimers, limitations of liability, indemnity, and governing law).
12. Governing Law & Disputes
These Terms are governed by the laws of Romania, without regard to conflicts of law principles. Any disputes will be resolved exclusively in the courts located in Romania, and you consent to personal jurisdiction and venue there. Where required by law, you retain any non‑waivable rights as a consumer.
13. Changes to Terms
We may update these Terms from time to time. If changes are material, we will provide notice (e.g., by email or in‑app) before they take effect, when required. Your continued use after the effective date constitutes acceptance of the updated Terms.
